1. Summary of Terms and Conditions

Products: Only digital games (PDF, STL, or other files) in Print & Play format are offered.

Purchases: Transactions are completed upon payment confirmation. Stripe and PayPal are accepted.

Delivery: Downloads are available immediately after payment. No physical shipping is provided.

Usage License: Users acquire a personal, non-transferable right of use only. Intellectual property belongs to the original designer or rights holder.

Restrictions: Copying, redistributing, reselling, or exploiting the files without express license is prohibited.

Designers: Creators must guarantee rights to their content; PRINT AND GAME may reject or remove material that violates laws or guidelines.

Liability: Products are sold “as is.” The Store is not liable for indirect damages but does provide support for download-related issues.


2. Privacy Policy

Controller: PRINT AND GAME

Data Collected: Name, email address, physical address, contact details, usage history, and cookies. Payment data is handled directly by Stripe and PayPal and is not stored on our systems.

Purpose: To manage the purchase and download of digital products, invoicing, related communications, and fraud prevention. With user consent, newsletters and promotional information may be sent.

Legal Basis: Execution of the purchase contract and the User’s consent for marketing purposes.

4. Refund Policy

Digital Products: Returns or cancellations are not accepted once the download has started.

EU Regulations: The 14-day withdrawal right does not apply when the User downloads digital content with their express consent.

Exceptions: If the file is defective or does not match the description, the User may contact [email/contact]. A replacement will be offered or, if not possible, a refund.

Commercial Licenses: Purchases of print licenses are final and non-refundable.

Payments via Stripe/PayPal: These platforms do not allow automatic refunds. Any claims must be handled through PRINT AND GAME support.


5. Agreement for Designers (Game Authors)

Ownership: The Author guarantees that they own all rights to the game (rules, artwork, 3D models, etc.) or have the necessary licenses.

License to the Store: By publishing on PRINT AND GAME, the Author grants a non-exclusive license to sell their digital game on the marketplace. The Author retains all rights and is free to publish the game on other platforms.

Review Process: Before publication, the Store will review the game (files, quality, playability, legal compliance, and beta stage). It may be rejected or returned for changes if it does not meet quality standards or platform rules.

Advertising and Marketing:
PRINT AND GAME may use the provided materials (images, descriptions, game excerpts) for promotional and commercial purposes, always crediting the designer as the author.
The Store may also collaborate with selected content creators and influencers to boost visibility for both games and designers.

Revenue:

  • The Author receives 70% of the net sale price.
  • The Store retains 30% for managing the marketplace.
  • Stripe/PayPal fees are covered by the Store.
  • Payments can be automatically requested once the balance reaches $20 USD.

Author Obligations:
The Author must keep the game updated, avoid including illegal or unlicensed third-party content, and is responsible for any copyright or legal claims arising from their work.

Game Removal:
The Author may remove their game from the marketplace at any time directly through the platform, with no prior notice required.

Termination:
If the agreement is terminated (by either the Author or the Store), all pending sales up to the termination date will be settled.

Account Cancellation:
If the Author deletes their account, all their games will be removed from sale.
Any pending balance must be withdrawn before account closure.
Materials previously used in marketing or promotions may remain visible for informational or archival purposes.


6. Commercial License Terms (Physical Stores)

Purpose: Allows a physical retail store to print and sell up to 50 copies of a game over a 2-year period.

Payment: The license fee covers the usage rights only. Printing and material costs are the responsibility of the store.

Usage Rights:

  • Non-exclusive, non-transferable, and revocable.
  • Does not grant ownership of the game, only a limited license.
  • Reselling, sublicensing, or transferring the license is not allowed.

Scope: Sales are permitted only at the purchasing physical store. Online or wholesale sales are not allowed without express authorization.

Obligations:

  • Keep track of the number of copies produced and sold.
  • Stop sales upon reaching 50 units or after 2 years, whichever comes first.
  • Remove or destroy any remaining materials once the license expires.

Add-ons or Accessories: If the store creates boxes, inserts, or other components, the original game designer must always be clearly credited, along with the author of the additional elements.

Revocation: If the terms are violated, the license is automatically revoked, and the store will be liable for any resulting damages.

Rights Protection: The game remains the intellectual property of the original author. It may not be claimed as the store’s own or modified without permission.

No Refunds: The license purchase is final and non-refundable.
